Mutual NDA template for apparel manufacturing

Sign this mutual NDA template before you send us tech packs, artwork or patterns for a new design. It protects both sides, and your lawyer is welcome to review it or send your own NDA instead.

What the mutual NDA covers

It covers anything non-public that either side shares while we develop and make your garments: designs, logos, tech packs, patterns, measurements, fabric and trim specs, samples, prices and customer names. Designs and patterns made for you belong to you, and we do not show them to other customers or use your brand in our own marketing. It is mutual because we share pricing and supplier details with you too.

One caveat: an NDA limits who sees your designs, but it does not register a trademark or a design right. If the brand is new, protect it in your own market as well. Fill in your first tech pack on the tech pack template, find other files under trade downloads, or read how our private label sportswear program keeps your brand on the product.

How to sign and return the NDA

  1. 01Print it or save it as a PDF
  2. 02Fill in your company details and sign
  3. 03Email it to sales@empirefive.com
  4. 04We countersign and return it
